Process

From first call to signed agreement

  1. Inquiry and conflicts check

Counsel or a party calls or emails with the parties, the cause number if filed, and preferred dates. Nothing is booked until conflicts are cleared.

  2. Agreement to Mediate

Everyone signs the Agreement to Mediate. A confirmation letter sets the date, format and fee.

  3. Confidential submissions

Each side sends a short summary, the contract and the key documents. What a party marks confidential stays with the mediator.

  4. The session

Joint and private sessions, on Zoom or in person. Decision-makers with authority attend.

  5. Signed settlement

If the case settles, a Mediated Settlement Agreement that meets Rule 11 is signed that day. In pending cases, the mediator's report goes to the court.

The mediator

Joan Beltran

Joan has spent more than twenty years in customer-facing business roles, including eleven years running her own small business. She knows how owners weigh money, time and a working relationship, which is what most contract disputes come down to.

She is a facilitative mediator. She doesn't decide who is right and doesn't give legal advice. Her job is to run a fair process, keep the parties talking, and put the terms they reach in writing.
